Terms of Use for CardioBoxer

1. About CardioBoxer

CardioBoxer is a mobile application designed to connect with compatible CardioBoxer machines, track workout sessions, save results, display leaderboards, and provide social features such as profiles, comments, followers, and session history.

The app is intended for entertainment, training, and fitness engagement purposes.

2. Account Registration

To use certain features of the app, you may need to create an account.

You agree to provide accurate, current, and complete information when creating or using your account.

You are responsible for keeping your login details secure and for all activity that occurs under your account.

3. User Profile

Your profile may include information such as:

• username,
• profile photo,
• workout results,
• session history,
• leaderboard position,
• comments,
• followers and following.

Some profile information may be visible to other users, depending on app functionality and your activity in the app.

You are responsible for the information and content you add to your profile.

4. Use of the App

You agree to use CardioBoxer only for lawful purposes and in accordance with these Terms.

You must not:

• use the app in a way that violates the law,
• attempt to hack, damage, disrupt, or overload the app,
• reverse engineer, copy, or modify the app without permission,
• manipulate workout results or leaderboard scores,
• cheat, fake, or interfere with machine or app data,
• create fake accounts,
• impersonate another person or company,
• post offensive, abusive, illegal, misleading, or harmful content,
• upload content that violates someone else's rights,
• use the app in a way that may harm other users, our services, or connected machines.

5. Connection with CardioBoxer Machines

The app may connect with compatible CardioBoxer machines using QR codes, passcodes, Bluetooth, internet connection, or other supported methods.

A stable connection may be required to start and save workout sessions correctly.

We are not responsible for results, sessions, or data that are not saved due to:

• loss of internet connection,
• Bluetooth connection issues,
• device issues,
• user interruption,
• machine configuration,
• app or system errors,
• technical problems outside our control.

6. Camera and Bluetooth Permissions

The app may request access to your camera and Bluetooth.

Camera access is used to scan QR codes displayed on CardioBoxer machines.

Bluetooth access is used to connect with compatible CardioBoxer machines.

CardioBoxer does not collect or use your location data.

7. Workout Sessions and Results

The app may save your workout results, session history, challenge scores, and leaderboard positions.

Workout results are generated automatically based on machine and app data.

Completed sessions may not be editable after they are saved.

Unfinished, interrupted, changed, or incomplete sessions may not appear in your saved history.

We may correct, remove, hide, or reset results if we believe they are inaccurate, manipulated, fraudulent, abusive, or caused by a technical error.

8. Leaderboards

CardioBoxer may include leaderboards and rankings based on workout results or challenge performance.

Leaderboards are provided for entertainment, competition, and fitness engagement purposes.

Your username, profile photo, result, ranking position, and selected session information may be visible to other users.

We may remove or modify leaderboard entries if we believe they violate these Terms or were caused by cheating, abuse, technical errors, or unauthorized activity.

9. User Content

The app may allow users to upload, publish, or share content, including profile photos, comments, usernames, and session-related information.

You are responsible for any content you submit.

By submitting content, you confirm that:

• you have the right to use and share it,
• it does not violate any law,
• it does not violate any third-party rights,
• it is not offensive, abusive, illegal, misleading, harmful, or inappropriate.

We may remove, hide, or moderate content that we consider inappropriate, unlawful, offensive, harmful, misleading, or in breach of these Terms.

10. Comments and Social Features

CardioBoxer may allow users to comment on sessions, follow other users, view profiles, and interact with selected app content.

You agree to communicate respectfully and not to harass, threaten, abuse, insult, or harm other users.

We may limit, suspend, or remove access to social features if we believe a user is misusing them.

11. Subscriptions and Paid Features

CardioBoxer may offer subscription-based features or paid services.

Payments are processed by Stripe, our third-party payment provider.

Before purchasing, you will be shown the price, billing period, renewal rules, and available features.

By purchasing a subscription or paid feature, you agree to the payment terms presented at checkout and to any applicable Stripe terms.

You are responsible for managing your subscription, payment method, renewal, and cancellation according to the payment flow available in the app or through Stripe.

We may change subscription prices, features, or billing options in the future. If required, you will be notified before such changes take effect.

12. Refunds and Cancellations

Subscription cancellation and refund rules may depend on the payment method and payment provider used.

If payments are processed through Stripe, cancellations and refunds may be handled according to the payment flow, checkout terms, and applicable law.

Unless required by law, we are not required to provide refunds for partially used subscription periods, unused features, or failure to cancel a subscription before renewal.

13. Account Deletion

You can delete your account directly in the CardioBoxer app by going to:

Settings → Delete Account

Deleting your account may permanently remove your profile, session history, comments, leaderboard data, followers, following lists, and other related information.

We may retain certain information where required for legal, security, fraud prevention, accounting, tax, or compliance reasons.

14. Safety Notice

CardioBoxer is related to physical activity and amusement equipment.

You are responsible for using the app and connected machines safely.

Before using any CardioBoxer machine, make sure that:

• you are physically able to participate,
• the machine is used according to its instructions,
• the area around the machine is safe,
• you use the machine responsibly,
• children use the machine only under appropriate supervision.

Stop exercising immediately if you feel pain, dizziness, discomfort, shortness of breath, or any other health-related symptoms.

CardioBoxer is not a medical device and does not provide medical advice, medical diagnosis, or professional fitness guidance.

15. Children

The app is not primarily intended for children.

Children may use the app or connected CardioBoxer machines only with supervision from a parent, guardian, or responsible adult.

Parents or guardians are responsible for the child's use of the app and connected machines.

16. Intellectual Property

The app, name, logo, design, software, graphics, animations, content, features, and related materials are owned by PPHU Ritter or its licensors.

You may not copy, modify, distribute, sell, reverse engineer, decompile, or create derivative works based on the app without our written permission.

Using the app does not give you ownership of any intellectual property rights in the app or related services.

17. App Availability and Updates

We may update, modify, suspend, or discontinue the app or any feature at any time.

We do not guarantee that the app will always be available, error-free, uninterrupted, secure, or compatible with every device, operating system, or machine.

Updates may be required to continue using certain features.

18. Third-Party Services

The app may use third-party services, such as:

• payment providers, including Stripe,
• hosting providers,
• database providers,
• app store platforms,
• customer support tools,
• technical infrastructure providers.

Your use of third-party services may be subject to their own terms and privacy policies.

We are not responsible for third-party services, websites, platforms, or payment systems that we do not control.

19. Limitation of Liability

To the maximum extent permitted by law, PPHU Ritter is not liable for indirect, incidental, special, consequential, or punitive damages, including:

• loss of data,
• loss of profits,
• loss of business,
• loss of access,
• incorrect results,
• interrupted sessions,
• failed machine connection,
• app unavailability,
• technical errors,
• user injury caused by unsafe or improper machine use.

Nothing in these Terms limits liability that cannot be limited under applicable law.

20. Suspension or Termination

We may suspend or terminate your access to the app if:

• you violate these Terms,
• you misuse the app,
• you manipulate results,
• you post harmful or unlawful content,
• you create security, legal, or technical risks,
• your activity harms other users, the app, or connected services.

You may stop using the app at any time.

21. Privacy

Your use of CardioBoxer is also governed by our Privacy Policy.

Please read the Privacy Policy to understand how we collect, use, store, and protect your personal data.

22. Changes to These Terms

We may update these Terms from time to time.

If we make important changes, we may notify you through the app or by other appropriate means.

Continued use of the app after changes means that you accept the updated Terms.

23. Governing Law

These Terms are governed by the laws of Poland, unless mandatory consumer protection laws in your country provide otherwise.
